Information Notice on the Processing of Personal Data

Within the scope of the ChildSafely platform, operated by Robincode (hereinafter referred to as the "Platform"), we exercise utmost care in protecting the personal data of our children, parents, educators, and other users, and in safeguarding their fundamental rights and freedoms.

This Clarification Text has been prepared in accordance with Article 10 of the Law on the Protection of Personal Data No. 6698 ("KVKK") and relevant legislation, by Robincode as the Data Controller, to transparently inform you about the method of collecting your personal data, the purposes of processing, the parties to whom it may be transferred, the legal grounds, and your rights under the KVKK.

1. Data Controller

KVKK uyarınca kişisel verileriniz, veri sorumlusu sıfatıyla Robincode tarafından, ChildSafely platformunun işletilmesi ve aşağıda açıklanan hizmetlerin sunulması kapsamında işlenebilecektir.

ChildSafely is a digital platform and service brand operated by Robincode. Robincode is responsible for determining the purposes and means of personal data processing and for fulfilling the data controller obligations under the KVKK.

2. Personal Data Processed

Platformumuzu ziyaretiniz ve hizmetlerimizden faydalanmanız sürecinde, kullanıcı tipinize (ziyaretçi, üye, ebeveyn, eğitmen) bağlı olarak aşağıdaki kişisel verileriniz işlenebilmektedir:

• Identity Data: Name, surname, title (if you register or fill out a contact form).
• Contact Data: Email address and other contact information you provide to us within the scope of your communication requests.
• Transaction Security Data: IP address, site access date and time information, device and browser information (within the scope of fulfilling legal obligations and ensuring system security).
• Customer/User Transaction Data: Transaction and browsing records within the Platform, information regarding completed trainings and activities, and log records related to approved agreements and clarification texts.

3. Purpose of Processing Your Personal Data

Your collected personal data is processed for the following purposes, in accordance with the conditions specified in Articles 5 and, if applicable, 6 of the KVKK:

• ChildSafely platformu üzerinden sunulan hizmetlerin, eğitimlerin, etkinliklerin ve dijital araçların kullanıcılara eksiksiz olarak sağlanması ve üyelik süreçlerinin yürütülmesi,
• Kullanıcı hesaplarının oluşturulması, yönetilmesi ve platform erişimlerinin sağlanması,
• To respond quickly and accurately to your communication requests, questions, and support notifications,
• Platformun bilgi güvenliği süreçlerinin yürütülmesi, teknik hataların giderilmesi, kötüye kullanımın önlenmesi ve siber güvenliğin sağlanması,
• Eğitim ve platform kullanım süreçlerinin yürütülmesi ve hizmet kalitesinin geliştirilmesi,
• Yetkili kamu kurum ve kuruluşlarından gelebilecek hukuka uygun taleplerin karşılanması ve Robincode'un hukuki yükümlülüklerinin yerine getirilmesi,
• Çocuk kullanıcılar bakımından gerekli olduğu durumlarda veli/vasi bilgilendirme ve açık rıza süreçlerinin hukuka uygun şekilde yürütülmesi.

4. Method and Legal Basis for Personal Data Collection

Kişisel verileriniz; ChildSafely web sitesi ve dijital platformları, üyelik formları, iletişim formları, çerezler (cookies), sistem logları ve platform üzerinde gerçekleştirilen kullanıcı işlemleri aracılığıyla elektronik ortamda otomatik veya kısmen otomatik yöntemlerle toplanabilmektedir.

This data, within the scope of personal data processing conditions specified in Article 5 of the KVKK, and particularly;

• Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması (üyelik ve platform hizmetlerinin sunulması),
• Veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için kişisel veri işlemenin zorunlu olması,
• Necessity of data processing for the establishment, exercise, or protection of a right,
• İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması (sistem ve bilgi güvenliğinin sağlanması, kötüye kullanımın önlenmesi ve platform hizmetlerinin geliştirilmesi)

Yukarıdaki hukuki sebeplerin yeterli olmadığı ve mevzuat kapsamında açık rıza alınmasının gerekli olduğu durumlarda, kişisel verileriniz açık rızanıza; çocuk kullanıcılar bakımından gerekli olması halinde ise ilgili mevzuat çerçevesinde veli/vasi onayına ve/veya açık rızasına dayanılarak işlenebilecektir.

5. Transfer of Your Personal Data

Robincode does not sell user data obtained within the scope of the ChildSafely platform to third parties for commercial gain. Your personal data may only be transferred in line with the purposes stated above and in accordance with Articles 8 and 9 of the KVKK and relevant legislation, by taking necessary security measures.

• Hukuki yükümlülüklerin yerine getirilmesi amacıyla yetkili kamu kurum ve kuruluşlarına, adli ve idari makamlara,
• ChildSafely platformunun barındırılması (hosting), altyapı yönetimi, veri tabanı, bilgi güvenliği, e-posta gönderimi ve benzeri teknik hizmetlerin sağlanması amacıyla hizmet alınan yurt içi ve/veya yurt dışındaki teknoloji ve altyapı sağlayıcılarına,
• Hizmetlerin yürütülmesi için gerekli olması halinde ve mevzuatın izin verdiği ölçüde, sözleşmeli hizmet sağlayıcılar ve iş ortaklarına

In the event of personal data transfer abroad, transfer operations will be carried out in accordance with the conditions and appropriate safeguards stipulated in Article 9 of the KVKK and relevant secondary legislation.

6. Your Rights as a Data Subject Under KVKK Article 11

As a real person whose personal data is processed, you have the following rights under Article 11 of the KVKK:

• Kişisel verilerinizin işlenip işlenmediğini öğrenme,
• Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
• To learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
• To know the third parties to whom your personal data is transferred, domestically or abroad,
• Kişisel verilerinizin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme,
• Requesting the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
• Düzeltme, silme veya yok etme işlemlerinin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
• Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğranması halinde zararın giderilmesini talep etme.

7. Application and Communication to the Data Controller

To exercise your rights under Article 11 of the KVKK or to submit your questions and requests regarding the processing of your personal data, you can apply to Robincode, the Data Controller.
